1. About Us

These Terms of Service ("Terms") govern your use of the RetroBenz website, online store and related services and your purchase of products from us.

RetroAuto s.r.o. is referred to in these Terms as "RetroAuto", "RetroBenz", "we", "us" or "our."

The seller and contracting party for purchases made through the RetroBenz store is RetroAuto s.r.o.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services.


2. Scope of These Terms

These Terms apply to your access to and use of our website and to purchases made through our online store.

By placing an order with us, you agree to these Terms and any policies expressly incorporated into them, including our Privacy Policy and Refund Policy.

Nothing in these Terms excludes, restricts or otherwise affects rights that a consumer has under mandatory applicable law.

If you are a consumer, mandatory consumer-protection laws applicable to you take precedence over any conflicting provision of these Terms.


3. Customers and Accounts

You must have the legal capacity required under applicable law to enter into a purchase contract with us.

When you provide information through our store, you agree to provide information that is accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account credentials.

You must notify us promptly if you become aware of unauthorized access to or use of your account.

You may not transfer or sell your customer account to another person without our consent.


4. Products

We make reasonable efforts to describe and display our products accurately.

However, photographs, illustrations and other visual representations are provided for reference. Colors, finishes, textures, proportions and other visual characteristics may appear differently depending on lighting, photography, screen calibration and device settings.

Where dimensions, vehicle applications, model years, part numbers or other specifications are provided, customers should review them carefully before ordering.

We may change our product range, descriptions and availability from time to time.

Nothing in this section affects your statutory rights where goods do not conform to the contract or have been incorrectly described.


5. Classic Vehicles, Vehicle Condition and Fitment

RetroBenz supplies products intended, among other things, for classic and older Mercedes-Benz vehicles.

Customers acknowledge that many vehicles for which our products are intended have been in service for 30, 40, 50 years or more.

Over such periods, individual vehicles may have undergone significant changes from their original factory condition.

These changes may include, without limitation:

  • ageing and deterioration of original materials;

  • previous repairs;

  • accident repairs;

  • restoration work;

  • repainting;

  • bodywork;

  • welding;

  • replacement panels;

  • replacement trim;

  • aftermarket components;

  • previous modifications;

  • deformation;

  • corrosion;

  • shrinkage or expansion of materials;

  • warped or uneven mounting surfaces;

  • damaged mounting points;

  • missing or substituted fasteners;

  • non-original components; and

  • dimensional differences caused by age, use, repair or restoration.

As a result, two vehicles of the same model and model year may no longer have identical dimensions, surfaces, mounting points or surrounding components.

A product being designed for a particular Mercedes-Benz model does not constitute a guarantee that every individual vehicle of that model remains within its original factory dimensions or condition.

Customers are responsible for checking the suitability and compatibility of a product with their individual vehicle before installation where this can reasonably be determined.

If you are uncertain about compatibility, please contact us before ordering or installation.

Nothing in this section limits your statutory rights where a product supplied by us is defective, incorrectly described, incorrectly supplied or otherwise does not conform to the purchase contract.


6. Installation of Parts

Unless a product is expressly described as suitable for straightforward customer installation, we recommend that RetroBenz products be installed by a competent professional familiar with classic vehicles.

Installation of components on older vehicles can involve risks arising from the condition of the vehicle rather than from the replacement component itself.

These risks can include:

  • brittle or aged plastics;

  • fragile clips and fasteners;

  • deteriorated rubber;

  • damaged threads;

  • seized fasteners;

  • brittle wiring;

  • weakened mounting points;

  • aged paint or clear coat;

  • previously repaired surfaces;

  • warped panels;

  • uneven mounting surfaces; and

  • hidden corrosion or previous damage.

To the extent permitted by applicable law, RetroAuto is not responsible for damage caused by improper, incorrect, negligent or unsuitable installation or removal of a product, or by the pre-existing age, condition, modification or deterioration of the vehicle or its components.

This may include, where caused by those circumstances:

  • scratches;

  • dents;

  • cracks;

  • broken clips or fasteners;

  • paint damage;

  • surface damage;

  • deformation;

  • warping;

  • damage to trim;

  • damage to dashboards, panels or consoles;

  • damage to wiring or electrical components; and

  • damage occurring during removal of existing parts or installation of replacement parts.

Customers and installers should inspect the vehicle, mounting surfaces and surrounding components before installation.

Do not force a component into position if it does not fit correctly.

If a product appears incompatible, incorrectly sized, defective or otherwise unsuitable, stop installation and contact us before modifying the product or vehicle.

Nothing in this section excludes or limits RetroAuto's liability where the damage results from a defect or lack of conformity in the product for which RetroAuto is legally responsible, or where liability cannot lawfully be excluded.


7. Modification of Products

Cutting, drilling, sanding, painting, gluing, bending, permanently fastening or otherwise modifying a product may make it more difficult to determine whether an alleged problem existed when the product was supplied.

Customers should therefore inspect products and, where reasonably possible, test their positioning and compatibility before making irreversible modifications.

This provision does not remove any statutory consumer right or legal remedy that cannot be excluded by agreement.


8. Orders and Formation of Contract

Products displayed on our website constitute an invitation for customers to place an order.

By submitting an order, you make an offer to purchase the products in your order at the stated price and subject to these Terms.

Before submitting an order, you are responsible for checking the products, quantities, delivery information and other order information.

Where required by applicable law, the checkout interface will make clear that submitting the order creates an obligation to pay.

After receiving an order, we will send an electronic acknowledgement or confirmation.

A purchase contract is formed when we expressly accept the order or otherwise confirm acceptance in accordance with the checkout and order-confirmation process.

We may refuse or cancel an order where reasonably necessary, including because:

  • a product is unavailable;

  • there has been an obvious pricing or description error;

  • payment authorization fails;

  • we reasonably suspect fraud;

  • applicable law prevents us from fulfilling the order; or

  • delivery to the requested destination is unavailable.

If we cancel an order after payment has been received, we will refund the amount due.


9. Prices, VAT and Payment

Prices displayed through the store will be shown in the applicable currency.

Taxes, including VAT where applicable, will be displayed or included as required by applicable law.

Shipping costs and other applicable charges will be disclosed during checkout before the customer submits an order.

For deliveries outside the relevant customs territory, additional import duties, taxes, customs charges or handling fees may be imposed by authorities or carriers.

Unless expressly stated otherwise, such external import charges are not controlled by RetroAuto and may be the customer's responsibility.

Payment must be made using a payment method offered during checkout.

You represent that you are authorized to use the payment method submitted for your purchase.


10. Pricing and Description Errors

We make reasonable efforts to ensure that prices, descriptions and availability are accurate.

Occasionally, typographical, technical or other errors may occur.

If an obvious error affects an order, we may contact you to correct the issue or, where legally permitted, cancel the affected order and refund any amount paid.

Nothing in this section permits us to avoid a binding consumer contract in circumstances where applicable law does not allow us to do so.


11. Shipping and Delivery

Available shipping methods, estimated delivery periods and shipping charges are displayed during checkout where applicable.

Delivery dates and transit times are estimates unless we expressly agree to a guaranteed delivery date.

We are not responsible for delays resulting from circumstances outside our reasonable control, subject always to your mandatory rights under applicable consumer law.

You are responsible for providing a complete and accurate delivery address.

If an order is returned because the customer supplied an incorrect or incomplete address, failed to collect the shipment or otherwise caused delivery to fail, we may charge reasonable additional delivery costs where permitted by law.


12. Transfer of Risk

Where we dispatch goods to a consumer, risk of accidental loss or damage generally passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, obtains physical possession of the goods.

If the consumer independently commissions a carrier that was not offered by us, risk may pass upon delivery of the goods to that carrier to the extent provided by applicable law.

Nothing in these Terms reduces any rights you may have against a carrier or us under applicable law.


13. Inspection After Delivery

We recommend inspecting your shipment reasonably promptly after delivery.

If the package appears materially damaged, photograph the external packaging and the product where reasonably possible and contact us.

Providing photographs of packaging and damage can assist us in investigating a shipping claim.

Failure to inspect or report damage immediately does not remove statutory rights where applicable law provides otherwise.


14. Consumer Right of Withdrawal

If you are a consumer and the applicable law provides a statutory right to withdraw from a distance contract, you may exercise that right in accordance with applicable law.

For consumers in the European Union, this will generally include a right to withdraw from an online purchase of goods without giving a reason within 14 days from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods, subject to statutory exceptions.

Where an order contains multiple goods delivered separately, the statutory period is determined in accordance with applicable law.

To exercise the right of withdrawal, you must communicate an unequivocal decision to withdraw from the contract.

You may use the applicable model withdrawal form made available by us, but use of that form is not mandatory.


15. Returns Following Withdrawal

After exercising a statutory right of withdrawal, the goods must be returned within the period required by applicable law.

Unless we agree otherwise or applicable law requires us to bear the cost, the consumer bears the direct cost of returning the goods.

Returned products should be appropriately packaged to prevent damage during return transportation.

Subject to applicable law, the consumer may be responsible for diminished value resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

This is particularly relevant to vehicle parts that have been scratched, drilled, cut, glued, painted, permanently mounted or otherwise modified during attempted installation.

Any deduction for diminished value will only be made where and to the extent permitted by applicable law.


16. Refunds Following Withdrawal

Where a consumer validly exercises a statutory right of withdrawal, we will reimburse payments as required by applicable law.

This generally includes the price paid and, where legally required, the cost of the least expensive standard delivery method offered by us.

We may withhold reimbursement until we have received the returned goods or the consumer provides evidence of having sent the goods back, whichever occurs first, where applicable law permits us to do so.

Refunds will generally be made using the same payment method used for the original transaction unless another method is expressly agreed and does not impose additional costs on the consumer.

Nothing in our Refund Policy limits mandatory statutory rights.


17. Exceptions to the Right of Withdrawal

The statutory right of withdrawal may not apply to certain products or transactions where an exception provided by applicable law applies.

For example, depending on the circumstances and applicable law, an exception may apply to goods manufactured according to the consumer's specifications or clearly personalized for that consumer.

We will not treat an ordinary standard-stock product as exempt merely because it is intended for a particular vehicle.

Any statutory exception will be applied only where its legal requirements are satisfied.


18. Defective Goods and Statutory Rights

Consumers have mandatory legal rights concerning goods that are defective or otherwise do not conform to the purchase contract.

Nothing in these Terms, our Refund Policy, a product description or any commercial warranty restricts those mandatory rights.

Where applicable law makes RetroAuto responsible for a lack of conformity, the consumer may be entitled to remedies provided by that law.

Whether a product lacks conformity must be distinguished from a problem caused solely by the condition, modification, deterioration, incorrect installation or non-original dimensions of an individual classic vehicle.

If you believe a product is defective or incorrectly supplied, please contact info@retrobenz.com with your order information and a description of the issue.

Where helpful, we may ask for photographs, measurements or other reasonable information necessary to identify the problem.


19. Product Compatibility

Where we identify a product as compatible with particular Mercedes-Benz models, chassis codes, generations or model years, that information describes the intended application of the product based on the information reasonably available to us.

Compatibility information assumes, unless stated otherwise, that the relevant area of the vehicle corresponds materially to the applicable original configuration.

It cannot account for every repair, restoration, modification, replacement component, manufacturing variation or change that may have occurred during decades of vehicle use.

Customers should therefore check relevant product descriptions, dimensions, photographs, part numbers and compatibility information before purchase and installation.

If we have made a specific incorrect compatibility representation concerning a product, nothing in this section removes any rights you may have under applicable law.


20. Mercedes-Benz Trademarks and Brand Independence

Unless expressly stated otherwise, RetroAuto s.r.o. and RetroBenz are independent businesses and are not affiliated with, sponsored by, endorsed by or authorized by Mercedes-Benz Group AG or its affiliated companies.

References to Mercedes-Benz, vehicle model names, chassis codes, part references or other third-party trademarks are used where reasonably necessary to identify compatibility or intended application.

All third-party trademarks belong to their respective owners.


21. Our Intellectual Property

The RetroBenz website and its original content, including RetroBenz branding, product photography, graphics, text, videos, designs and other materials, are owned by or licensed to RetroAuto s.r.o. and are protected by applicable intellectual-property laws.

You may use our website for personal, non-commercial shopping purposes.

Unless permitted by law or expressly authorized by us, you may not reproduce, distribute, republish, commercially exploit or create derivative works from our protected content.

No provision of these Terms transfers ownership of our intellectual property to you.


22. Third-Party Tools and Links

Our Services may provide access to third-party websites, payment services, applications or tools.

Those services may be governed by separate terms and privacy policies.

We are not responsible for independent third-party services to the extent they are outside our control, except where applicable law provides otherwise.

You should review the applicable third party's terms before using its services.


23. Relationship With Shopify

RetroBenz is powered by Shopify, which enables us to provide the Services to you.

However, purchases from the RetroBenz store are made directly from RetroAuto s.r.o., not Shopify.

Shopify provides the e-commerce platform and related technology and is not the seller of RetroBenz products.

Nothing in this section excludes rights or remedies that cannot lawfully be excluded.


24. Privacy

Personal information collected through the Services is processed in accordance with our Privacy Policy.

Because our Services are powered by Shopify, certain personal information is also processed by Shopify in connection with its platform and services.

Please review our Privacy Policy for further information about how personal information is collected, used, disclosed and protected.


25. Reviews, Feedback and User Content

If you voluntarily submit a product review, photograph, suggestion, comment or other content ("Feedback"), you represent that you have the right to provide that content and that it does not unlawfully infringe the rights of another person.

You grant RetroAuto a non-exclusive, worldwide, royalty-free license to use, reproduce and display Feedback for purposes connected with operating, improving and promoting RetroBenz and our products, subject to applicable law.

This license does not transfer ownership of your Feedback to us.

You must not submit unlawful, defamatory, fraudulent, infringing, malicious or misleading content.


26. Prohibited Uses

You may not use our Services:

  • for unlawful purposes;

  • to commit fraud;

  • to infringe intellectual-property rights;

  • to distribute malware or malicious code;

  • to interfere with the security or operation of the website;

  • to collect personal information unlawfully;

  • to impersonate another person;

  • to submit materially false information; or

  • to access systems or information without authorization.

We may take reasonable technical or legal measures to protect our Services from abusive or unauthorized automated access.


27. Suspension and Termination

We may restrict or terminate access to customer accounts or Services where reasonably necessary because of:

  • material violation of these Terms;

  • fraud or suspected fraud;

  • security threats;

  • unlawful conduct;

  • abuse of our Services; or

  • legal or regulatory requirements.

Termination does not affect rights or obligations arising before termination.


28. Website Availability

We aim to provide reliable access to our Services but cannot guarantee that the website will always be uninterrupted or error-free.

We may temporarily suspend or modify website functionality for maintenance, security, updates or other legitimate operational reasons.

This does not affect obligations relating to orders already accepted or mandatory consumer rights.


29. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms limits mandatory consumer rights or liability that cannot legally be excluded.

Subject to the foregoing, RetroAuto is not responsible for loss or damage caused solely by:

  • incorrect installation or removal;

  • unauthorized modification of a product;

  • misuse of a product;

  • failure to follow supplied instructions;

  • use of a product for an unintended application;

  • pre-existing vehicle defects;

  • deterioration associated with the age or condition of a vehicle;

  • previous repairs or modifications;

  • warped, damaged or non-original mounting surfaces; or

  • acts or omissions of independent installers or other third parties,

except to the extent RetroAuto is legally responsible for the relevant loss or damage.

For customers acting in the course of business rather than as consumers, additional limitations permitted by applicable law may apply.


30. Force Majeure and Events Outside Our Control

We are not responsible for failure or delay caused by events outside our reasonable control to the extent permitted by applicable law.

Such events may include natural disasters, severe weather, war, civil disturbance, government restrictions, widespread transport disruption, strikes outside our organization, major telecommunications failures or other comparable events.

Where such an event affects an accepted consumer order, mandatory rights concerning performance, cancellation and reimbursement remain unaffected.


31. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will apply to the maximum extent permitted by law or, where appropriate, be treated as severed.

The remaining provisions will continue to apply.


32. No Waiver

If we do not immediately exercise a right available under these Terms, this does not necessarily constitute a waiver of that right.


33. Governing Law

These Terms and contracts concluded with RetroAuto s.r.o. are governed by the laws of the Czech Republic, subject to mandatory applicable law.

If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under applicable law.

Nothing in these Terms requires a consumer to bring proceedings exclusively before a Czech court where applicable law gives that consumer the right to bring proceedings elsewhere.


34. Consumer Complaints and Alternative Dispute Resolution

Nothing in this section prevents either party from exercising rights available before a competent court.


35. Changes to These Terms

We may amend these Terms from time to time to reflect changes in our business, Services, products or applicable law.

The current version will be published on our website with an updated revision date.

Changes will not retroactively alter an existing purchase contract unless permitted by law or agreed with the customer.

Where applicable law requires additional notice concerning a change, we will provide that notice.
